Welcome to Unlooped

These Terms of Service ("Terms") govern your use of the Unlooped mobile application ("App") developed by David O'Dey ("we," "us," or "our"). By downloading, installing, or using Unlooped, you agree to these Terms.

1. Acceptance of Terms

By accessing and using Unlooped, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. License to Use

2.1 Grant of License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Unlooped on your iOS devices for personal, non-commercial purposes.

2.2 Restrictions

You may NOT:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Sell, rent, lease, or sublicense the App
• Use the App to create a competing product or service

3. User Accounts and Data

3.1 No Account Required

Unlooped does not require you to create an account. All data is stored on your device.

3.2 Your Data

You retain all rights to the data you create in Unlooped:

• Your habit data belongs to you
• We do not claim ownership of your content
• You're responsible for backing up your data
• We're not liable for data loss (though we work hard to prevent it)

3.3 iCloud Sync

If you enable iCloud sync:

• Your data is stored in your personal iCloud account
• Apple's terms and policies apply to iCloud storage
• You're responsible for your iCloud storage limits
• We cannot access or recover your iCloud data

4. Premium Subscriptions

4.1 Free and Premium

Habit tracking on Unlooped is free for everyone, forever — including unlimited build-mode habits, quit mode, streaks, milestones, basic insights, and standard widgets. Premium is an optional subscription that unlocks additional features (including personalized rewards, goal thresholds, Face ID-protected private habits, the private AI coach, and full insights):

• Monthly subscription: $1.99/month
• Annual subscription: $9.99/year
• Prices may vary by region

4.2 Payment and Billing

• Payment is processed through Apple's App Store
• Charged to your iTunes Account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Account will be charged for renewal within 24 hours prior to the end of the current period

4.3 Managing Subscriptions

• Manage subscriptions in iPhone Settings → Subscriptions
• Cancel anytime through your iPhone Settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods

5. Acceptable Use

5.1 Permitted Use

You may use Unlooped to:

• Track personal habits and routines
• Build positive habits and quit negative ones
• Analyze your progress and patterns
• Set reminders and notifications

5.2 Prohibited Use

You may NOT use Unlooped to:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Distribute malware or harmful code
• Attempt to hack or compromise the App
• Use automated systems to access the App

6. Intellectual Property

6.1 Our Rights

Unlooped and all related content are protected by copyright and other intellectual property laws:

• The App, design, and code are owned by David O'Dey
• All trademarks, logos, and service marks are our property
• You may not use our branding without permission

6.2 Your Rights

You retain all rights to the content you create in the App (habit names, notes, etc.).

7. Private AI Coach

The private AI coach (Premium only) is powered by Apple Intelligence and runs entirely on your device:

• Provides context-aware responses based on your local habit patterns
• Is for informational and motivational purposes only
• Should not replace professional medical or psychological advice
• May not always be accurate or suitable for every situation
• Processes all conversations on your device — nothing is sent to a server
• Requires iPhone 15 Pro or newer with iOS 26+; older devices receive template responses instead

8. Disclaimers

8.1 No Warranties

Unlooped is provided "AS IS" and "AS AVAILABLE" without warranties of any kind:

• We don't guarantee the App will be error-free or uninterrupted
• We don't warrant that the App will meet your requirements
• We make no guarantees about the accuracy of AI insights
• Your use of the App is at your own risk

8.2 Medical Disclaimer

Unlooped is not a medical or therapeutic device:

• Not intended to diagnose, treat, or cure any condition
• Not a substitute for professional medical advice
• Consult healthcare providers for medical concerns
• We're not liable for health-related decisions made using the App

9. Limitation of Liability

To the maximum extent permitted by law:

• We're not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for Premium (if any) in the past 12 months
• We're not responsible for data loss, device damage, or other losses
• Some jurisdictions don't allow these limitations, so they may not apply to you

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

11. Changes to the App

We reserve the right to:

• Modify or discontinue features at any time
• Update the App with new features or improvements
• Change Premium pricing with 30 days notice to existing subscribers
• We'll do our best to notify you of significant changes

12. Changes to These Terms

We may update these Terms from time to time:

• Changes will be posted on this page
• Significant changes will be announced in the App
• Continued use after changes constitutes acceptance
• If you don't agree to changes, stop using the App

13. Termination

13.1 Your Rights

You can stop using Unlooped anytime by:

• Deleting the App from your device
• Canceling your Premium subscription

13.2 Our Rights

We may suspend or terminate your access if you:

• Violate these Terms
• Use the App in ways that harm us or others
• Engage in fraudulent or illegal activities

14. Apple App Store

Additional terms for App Store users:

• These Terms are between you and us, not Apple
• Apple has no obligation to provide support for Unlooped
• Apple is not responsible for the App or its content
• Apple is a third-party beneficiary of these Terms
• Apple's standard Terms and Conditions also apply

15. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of the United States.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Unlooped.
